But if you have decided to sell your home on your own we would like to help you have a successful outcome to your transaction. From a title perspective there are several items you need to address before you put your home on the market.
In order to convey your property you must be able to provide "Marketable Title". Having a preliminary title commitment that will disclose any encumbrances or defects, which allows you to address them before the sale.
You must determine who will be preparing the closing documents needed to complete your sale once you have sold the property. These documents include the HUD Statement, Escrow Agreements, and the Warranty Deed. This service should be in place before the sale so you will have the proper documents ready.
You will need a third party to receive the earnest money deposit from the purchaser.
Depending on your transaction, a number of other documents may be necessary in order to complete your sale:
Sellers Disclosure Form disclosing the condition of the property
Based Paint Disclosure Statement
Smoke Detector Affidavit
Responsibilities of Sellers Under Residential Lead-Based Paint Hazard Reduction Act Disclosure
Once you have sold your home, the following will need to be completed by a title company:
Validate and prepare payment of outstanding taxes to be charged or credited at the closing
Validate and prepare payoffs of outstanding mortgages and/or liens on the property
